Terms and conditions of use of the platform
This platform is an internet platform and mobile application for equestrian sports ("Platform"), operated by ComGen Solutions B.V. ("ComGen Solutions" or "we").
These Terms of Use govern the use of our Platform. Users of our platform are only permitted to access and use the platform under the following conditions.
1. Applicability
1.1. These Terms of Use describe the conditions under which you can use our platform. The use includes, but is not limited to, accessing, browsing and registering for our Platform.
1.2. Please read these Terms of Use carefully before using our Platform. We recommend saving or printing a copy for future reference.
1.3. By using our Platform, you confirm that you accept these terms and conditions. If you do not agree, you may not use the Platform.
1.4. If you are using the Platform on behalf of an organisation, you declare that you are authorised to represent it.
1.5. You are solely responsible for access to the Platform and for compliance with these Terms by Anyone who accesses it through your internet connection.
2. Services
2.1. The Platform allows users to store, post, post content from the equestrian world, to upload or share.
2.2. We provide access to the Platform, templates, sharing capabilities and related services.
2.3. Users may have access to other Users' Content under these Terms.
3. Fees and payment
3.1. Access to the Platform is free of charge for standard services.
3.2. Additional services (such as subscriptions) can be offered for a fee.
3.3. Costs will only be charged after prior notice.
3.4. When purchasing a subscription, you have a 14-day right of withdrawal. You can do this via info@EquiConnect.horse.
3.5. Refunds will be made within 14 days at the latest via the same payment method.
4. Your Account and Password
4.1. You must keep your username and password confidential.
4.2. We reserve the right to block accounts in case of violation of these Terms.
4.3. You are responsible for equipment and software necessary for use of the Platform.
5. Intellectual property rights
5.1. All intellectual property rights in the Platform, the services and our content are vested in us.
5.2. Rights that have not been explicitly granted remain reserved by EquiConnect.horse.
6. Your Content and Licenses
6.1. You warrant that you are entitled to post content and that it does not violate any rights of third parties.
6.2. By posting content, you grant us a worldwide, royalty-free license to use it for our services.
6.3. We are under no obligation to review content and are not liable for any User Content.
6.4. We may disclose identity in the event of formal complaints or legal obligations.
6.5. Posting unlawful, abusive, threatening or obscene material is prohibited.
6.6. Removal of Content terminates the License, except for sub-licenses already granted.
6.7. We may remove content that violates any law or policy.
6.8. You remain responsible for your own copy of your content.
6.9. User opinions do not represent those of EquiConnect.horse.
7. Infringement
Procedures for reporting infringement of intellectual property rights have been laid down. Reports can be submitted via the complaint form.
In the event of repeated infringement, an account may be terminated.
8. Purchases via EquiConnect.horse
EquiConnect.horse facilitates offers, but is not a webshop. Purchase agreements are concluded directly between buyer and seller.
9. Availability and Limitations
We may limit, modify or discontinue the availability of the Platform without prior notice.
10. Liability
To the extent permitted by law, we exclude liability and warranties. Use of the Platform is at your own risk.
11. Privacy Policy
By using the Platform, you agree to our privacy policy.
12. Termination
We may terminate accounts for violations of these terms. Deletion requests can be submitted by email.
13. Other
If any provision is found to be invalid, the remainder of these terms and conditions will remain in full force and effect.
14. Governing Law
These terms of use are governed by Dutch law. Disputes are submitted to the competent court of Midden-Nederland (Utrecht).
